1. Contract partner
The contract is concluded between a natural or legal person (hereinafter referred to as the customer) and dn webservices GmbH, with its registered office in Wallisellen (hereinafter referred to as dn).
2. Offer in the sense of blockchain technology
The dn operates the staking pool with the ticker CASCH within the decentralized network of Cardano (https://cardano.org/). The software code for the decentralized network is always publicly accessible and can be checked by anyone (in the sense of the basic idea of block chain technology). The customer can stake via the staking pool CASCH, as long as the staking pool is able to act without restrictions. The offer is therefore not directed to minors, for example.
3. Features of the Staking Pool
The staking pool has – as of today – the following characteristics:
Variable fee: 2.5%.
Fixed fee: 340 ADA (Cardano)
Pledge: Minimum 500’000 ADA (Cardano)
The dn would like to maintain a sustainable customer relationship. The fees and the pledge should only be adjusted if absolutely necessary. Nevertheless, the dn reserves the right to adjust the characteristics of the stake pool at any time. The dn keeps the characteristics of the stake pool up to date on the cardano-staking.ch website, where the customer can view them.
4. Rewards (“Rewards”)
The distribution of the rewards is fully automated by the software after 2 epochs (approx. 10 days) without influence of dn after deduction of the fixed and variable fee (paragraph 3) in relation to the number of clocked ADAs to the pool size (total number of all clocked ADAs). As with all Cardano Staking Pools, the performance (number of mined blocks) cannot be fully guaranteed and is primarily dependent on the pool size.
5. Disclaimer / limited influence of dn
The block chain technology is comparatively young technology. It is up to the customer to sufficiently deal with the technological properties.
Only the owner of the private key has access to clocked ADAs. The dn recommends the customer to keep his private key safe (e.g. hardware wallets); it is the customer’s sole responsibility to keep it safe. The dn does not know the customer’s private key and does not want to know it. The dn is not liable for the safe storage of the private key.
dn operates the staking pool using the officially provided software code of Cardano. The dn has no influence on the code itself and assumes no liability with regard to the software code or its correct implementation.
The network is decentralized. The Staking Pool is only a small element of the Cardano network. The dn has no direct and immediate influence on the decentralized network itself and assumes no liability in this respect.
The dn operates the staking pool with Swiss quality and has had an uptime of 100%. The servers are modernly equipped and are regularly maintained and checked. Nevertheless, the dn assumes no liability for the operation of the Stake Pool.
Furthermore, any liability is limited to the extent permitted by law.
6. Identity unknown / Change of legal framework
Due to the decentralized and public nature and the current state of technology, it is publicly known which public keys and which stake pools are used. The identity of the stake pool is unknown due to the technology – state of the art today. It is possible that in the future legislators will make higher demands, which the dn will meet as far as possible.
7. Start and end of contract
The contract shall commence with the staking by the customer on the staking pool CASCH. The contract ends automatically when the customer unstacks on the Staking Pool CASCH.
If dn no longer offers the staking pool, the contract ends without further notice. In principle, dn has a long-term interest in the operation of the staking pool.
8. Community Thought
The dn will try within the bounds of its possibilities to further develop the Cardano community. However, this does not create any obligation for the dn.
9. Amendment of the regulations / severability clause
The dn reserves the right to adapt these provisions at any time.
Should individual provisions of this contract be invalid or unenforceable or become invalid or unenforceable after the conclusion of the contract, the validity of the rest of the contract remains unaffected. The invalid or unenforceable provision shall be replaced by a valid and enforceable provision, the effects of which come closest to the economic objective that the parties to the contract had pursued with the invalid or unenforceable provision. The above provisions shall apply accordingly in the event that the contract proves to be incomplete
10. Applicable law and place of jurisdiction
The contract is subject exclusively to Swiss law. Exclusive place of jurisdiction is the registered office of dn. dn is also entitled to sue the customer at his seat/residence.
